This website is operated by MACABU PTY LTD, ACN 695 691 055, registered in the Australian Capital Territory, Australia (“Macabu”, “we”, “us”). These terms apply to your use of this website. Please read them together with our privacy policy.

By using the website, you agree to these website terms. They do not replace a signed proposal, statement of work or other agreement for services, and do not remove rights you have under applicable law.

1. Enquiries and project agreements

This website describes our software development, integration, eCommerce, AI consulting and related services. Its content is general information, not a binding offer, a project specification or advice tailored to your circumstances. Past work illustrates experience and does not guarantee the same outcome for another project.

Sending an enquiry does not commit either party to a project, create a paid engagement or guarantee availability. Before work begins, we agree the relevant terms separately in writing, including scope, deliverables, fees, payment, timing, responsibilities, confidentiality, intellectual property and any ongoing support.

Source-code handover, hosting, third-party subscriptions and maintenance depend on the relevant agreement. The website does not promise unlimited revisions, continuous support or a particular service level. If a project agreement conflicts with these terms on a project matter, the project agreement applies, subject to law.

2. Acceptable use

You may use this website to learn about Macabu and make legitimate enquiries. You must not:

• Interfere with the site, introduce malicious code or attempt unauthorised access to systems or information.
• Use the form for spam, impersonation, unlawful content or communications that infringe another person’s rights.
• Bypass verification controls or use automated requests in a way that disrupts the site or its availability.

We may restrict access where reasonably necessary to address misuse, protect the site or comply with law. This does not change rights or obligations under a separate client agreement.

3. Information you submit

Provide accurate contact information and only share material you are authorised to provide. You retain your rights in submitted material; sending it does not transfer ownership to Macabu. We may use it to assess and respond to your enquiry, as described in our privacy policy.

Keep initial enquiries to an overview. Do not submit passwords, access keys, payment details or sensitive personal information. If a discussion requires confidential business material, we can first agree confidentiality terms and a suitable way to share it.

4. Website content and intellectual property

Website text, design, code and branding are owned by Macabu or used under licence, unless stated otherwise. Third-party trademarks, logos, photographs and product materials remain the property of their respective owners.

You may view the website and keep or print copies for your own reference or to evaluate working with us, retaining ownership notices. Other reproduction, publication or commercial reuse needs permission from the relevant rights holder, except where permitted by law or the applicable licence. Do not use Macabu’s branding to imply an endorsement or relationship without permission.

5. External platforms and links

Linked products, platforms and websites have their own operators, terms, privacy policies and pricing. A platform logo or integration reference does not by itself mean Macabu is an official partner, certified provider or endorsed by that platform.

We do not control third-party sites or their availability. Review their terms before purchasing, installing a product or providing information. These terms do not govern a separate product accessed through an external link.

6. Accuracy and availability

We aim to keep the website accurate and useful, but information may become outdated and access may be interrupted for maintenance, technical issues or events outside our control. Confirm details material to your decision with us before relying on them.

We do not promise uninterrupted access, error-free content or that general information will suit a particular project. This does not excuse misleading conduct or override an agreed service obligation or the protections below.

7. Consumer rights and liability

Nothing in these terms excludes, restricts or modifies a consumer guarantee, remedy or other right under the Australian Consumer Law or other applicable law that cannot lawfully be excluded, restricted or modified. Where those protections apply, you retain the remedies provided by law.

Responsibility for loss arising from this website is determined under applicable law. Liability for paid services is addressed in the relevant project agreement, subject to those same statutory protections. These website terms do not require you to waive a legal remedy or indemnify Macabu.

8. Changes to these terms

We may update these terms as the website or legal requirements change. Updates apply to website use from the date they are published, shown above. They do not retrospectively change an existing project agreement or rights that have already arisen.

9. Questions and governing law

Use our contact form for questions about these terms or concerns about the site. Describe the issue and the outcome you seek so we can review it. This does not prevent you from seeking advice or using a complaint process or remedy available under law.

These website terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia. ACT courts have non-exclusive jurisdiction, subject to any mandatory rights you have to bring a claim elsewhere.
